International Business Associates Group for Money Transfer Services IBAG S.A.E. (hereinafter referred to as “IBAG” and/or “We” and/or “Us” and/or “Our”) is an Egyptian Joint Stock company with its head office located at unit W402 – 403, Galleria 40, Sheikh Zayed, 6th of October, Giza, Egypt. IBAG is Western Union agent in Egypt since 1995, regulated by the Central Bank of Egypt (CBE). IBAG provides remittance service to payout Western Union transactions in Egypt to Our customer(s). 

References to “You”, “Your” and “Yours” are references to the person(s) accessing the Site.

These Terms & Conditions constitute a legally binding agreement made between You and IBAG. These Terms & Conditions govern your access to and use of IBAG Site, content, and information that IBAG provides (collectively referred to herein as the “Site”). By accessing the Site, You will be deemed to have read, understood, and agreed to be bound by all these Terms & Conditions. The information and other material provided in the pages of the Site (including the Terms) may be changed at any time without notice by updating this posting. You agree to review the Site regularly and your continued access to, or use of, the Site following any changes will mean that you agree to any changes (including any amended Terms).

Usage of IBAG Services via IBAG Mobile App by our customers shall be subject to separate Terms & Conditions that apply on IBAG services contained in IBAG Mobile Application, also Western Union services (WU) Terms & Conditions is considered as an integral part of this Agreement and complementary part thereto. In the event of any conflict or discrepancy between WU Terms & Conditions and Our Website Terms & Conditions and/or IBAG Mobile App Terms & Conditions, WU Terms & Conditions shall prevail. If You do not agree with any or all of these Terms & Conditions, then You are expressly prohibited from using IBAG Site and IBAG Application, accordingly You must discontinue use immediately.

Your Representations

You agree not to upload or otherwise transmit unsolicited commercial email or “spam” or any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; and not to Interfere with or disrupt Our Site or servers or networks connected to Our Site or service(s).

Data protection and security

We may as a result of your interaction with IBAG Site hold and process personal information obtained about you when you access the Site. We may use this information for the purposes of fraud prevention and audit, to identify services which may be relevant to You and Our customers from both within IBAG or through our third-party partners and to evaluate the effectiveness of our marketing of the Site and for statistical analysis.We will not disclose any such information outside IBAG or its partners, except where we are authorized by You or by the law to do so, for fraud prevention purposes, if obliged by law or a regulator, or by confidential agreement to sub-contractors or people acting as our agents in the performance of the services we provide.

By agreeing to these Terms and Conditions, You agree to such data being used and that it may be transmitted to others as stated above.

‘IBAG’ logo is a trademark of International Business Associates Group for Money Transfer Services IBAG (S.A.E). You agree not to display or use, in any manner, Our trademarks, without our prior permission.

We are the owner or the licensee of all intellectual property rights contained on the Site, with exception to those trademarks or copyrights which belongs to our partners or third parties, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on Our Site (collectively referred to as the “Content”), as well as the trademarks, service marks, and logos contained therein (the “Marks”).

We reserve all rights of our Site, Content, and Marks. Our Content and Marks are protected by intellectual property laws and treaties in Egypt and world-wide.

The Content and Marks are provided on or through Our Site “AS IS” for your personal and non-commercial use only. 

Except as set out in this section or elsewhere in Our Terms & Conditions, no part of Our Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any purpose whatsoever, without our express prior written permission. 

Any breach of these Intellectual Property Rights will constitute a material breach of these Terms & Conditions, Your right to use Our Site and/or Services will terminate immediately accordingly.

IBAG Site may contain links to other websites (“Third-Party Websites”) as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties (“Third-Party Content”). Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by Us, and We are not responsible for any Third- Party Websites accessed through IBAG Site or any Third-Party Content posted on, available through, or installed from IBAG Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies of or contained in the Third-Party Websites or the Third-Party Content. Applicable Law and Dispute Settlement

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Arab Republic of Egypt. Any legal action or proceeding arising under these Terms & Conditions shall be subject to the jurisdiction of Giza Courts.

Corrections 

There may be information on IBAG Services that contains typographical errors, inaccuracies, or omissions, including descriptions and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on IBAG Services at any time, without prior notice.

Miscellaneous

These Terms & Conditions and any policies or operating rules posted by Us on the Site or in respect to the Site constitute the entire agreement and understanding between You and Us. If any provision(s) of these Terms & Conditions are deemed unlawful, void or for any reason unenforceable, then such provision will be deemed severable for these Terms & Conditions and will not affect the validity and enforceability of the remaining provisions.
